OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER, WIN, OR CLAIM A PRIZE.

A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCE OF WINNING.

Eligibility:

The “Won-And-Done” Sweepstakes (the “Sweepstakes”) is open to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older at time of entry.  Employees of Boehringer Ingelheim Animal Health USA Inc., (the “Sponsor”), PromoVeritas Ltd. (the “Administrator”), parent/affiliated companies, subsidiaries, advertising and promotion agencies and anyone professionally associated with this Sweepstakes, and anyone residing in the household of any of the foregoing (whether related or not) are not eligible to enter or win.  This Sweepstakes is void in Puerto Rico and where prohibited or restricted by law.

Sweepstakes Entry Period:

Enter between 9:00:00 AM ET on February 1, 2024 and 11:59:59 PM EST on September 30, 2024 (the “Sweepstakes Period”).

• The Sweepstakes Period is further divided into 3 quarterly periods (each a “Quarterly Period”) as defined in the chart below.
• For purposes of this Sweepstakes, a “day” is defined as a 24-hour period, beginning at 12:00:00 AM ET and ending at 11:59:59 PM ET except for the first day of the Sweepstakes where a day is defined as beginning at 9:00:00 AM ET and ending at 11:59:59 PM ET.
• For purposes of this Sweepstakes, a “quarter” is defined as a 3-month period, except for the last quarter of the Sweepstakes, where a quarter is defined as a 2-month period as per the Entry & Drawing Periods (the “Chart”) below.
• The Sponsor’s computer, or that of its designee, runs the official clock for the Promotion and will solely determine the time by which an entry is received.

To Enter:  There are 2 ways to enter:

1. 1. Quick Response (“QR”) code: At participating Veterinary Clinics scan the QR code on the “Won-And-Done” display using your web-enabled mobile device (“smart phone”); or
   2. Online: Go to Won-And-DoneSweeps.com.

   Once on the Sweepstakes registration page:

   • Complete the registration form by providing the information required which will include your first and last name, email address and mobile phone number;
   • Check the box to acknowledge that you agree to these Official Rules; and
   • Click the “Enter Now” button.

When using a smart phone, message and data rates apply. You agree to incur any and all charges demanded by your wireless carrier. Not all mobile devices offer wireless Internet access; and wireless Internet access may not be available in all areas. Proof of scanning the QR code does not constitute proof of completion or submission of an entry.

All entries become the property of the Sponsor and will not be returned. No entries may be submitted on behalf of another person.

Limit 1 entry per Quarter per person/email/mailing address. There is a maximum limit of 3 entries an entrant can receive in the Major Prize Drawing.

Prizes:

• 9 Quarterly Prize Winners (3 winners per Quarterly Period): One (1) BarkBox™ or meowbox® a month for 12 months. BarkBox™ prize awarded as one $360 gift card. Meowbox® awarded as two $155.70 gift cards each ($311.40 total). Terms and conditions as stated on the gift cards will apply. Winner can select only 1 – either the BarkBox™ or the meowbox® prize.
• 1 Grand Prize Winner: a 1-year supply of Boehringer Ingelheim Animal Health pet parasiticides products for the winner’s dog or cat. Approximate Retail Value (“ARV”): $400.00.

Further Prize Details:

• Maximum Total ARV of all prizes (based on all winners selecting the BarkBox™ which has the greater value than the meowBox®): $3,640.00.
• Odds of winning a Quarterly prize depends on the total number of eligible entries received in each Quarterly Entry Period. Odds of winning the Grand Prize depends on the total number of eligible entries received during the Sweepstakes Period.
• Terms and conditions as stated on the BarkBox™ and meowbox® gift card will apply.
• Limit 1 Quarterly Period prize per person/household/mailing address.
• Quarterly Prize Winners are eligible to win the Grand Prize.
• Grand Prize Winner: Sponsor will work with the Grand Prize Winner and their veterinarian to determine the appropriate prescription pet parasiticides products needed for his/her cat or dog (based on owner/pet information) and on the delivery of the product. Eligible products include:

NexGard® PLUS (afoxolaner, moxidectin, and pyrantel chewable tablets),
NexGard® COMBO (esafoxolaner, eprinomectin, and praziquantel topical solution),
NexGard® (afoxolaner), or
HEARTGARD® Plus (ivermectin/pyrantel).

• Winners are responsible for the payment of all applicable taxes on the prizes.
• All details of prizes not specified herein shall be determined solely by Sponsor.
• In no event will more Sweepstakes prizes be awarded than those listed in these Official Rules.
• Except as provided herein, no cash, transfers or prize substitution is allowed except at the discretion of Sponsor, who reserves the right where lawful to substitute a prize (or prize component) with one of comparable or greater value. If prize cannot be awarded due to circumstances beyond the control of Sponsor, a substitute prize of equal or greater retail value will be awarded; provided, however, that if prize is awarded but unclaimed or forfeited by recipient, prize may not be re-awarded, in Sponsor’s sole discretion.
• By accepting the prize, Winner acknowledges compliance with these Official Rules.

Winner Selection:

• Quarterly Prize drawing winners will be randomly selected on or about the Drawing Date listed in the Chart above from among all eligible entries received by the end date for that Quarterly Period. Entries submitted during a Quarterly Period will be eligible for the Quarterly Period drawing in which it was submitted as well as all subsequent drawings including the Sweepstakes Major Prize Drawing.
• Major Prize drawing will be conducted on or about the drawing date stated in the Chart to select the Grand Prize Winner from among all eligible entries received during the Sweepstakes Period.
• The Sweepstakes drawing will be conducted by PromoVeritas, the Administrator, an independent promotional verification service, on or about the dates listed in the Chart above.
• The Sponsor and/or Administrator are not responsible for any undelivered messages or emails, including without limitation, e-mails that are not received because of an entrant’s privacy or spam filter settings that may divert any winner notification or other Sweepstakes related email to a spam or junk folder.

Winner Notification:

• Winners will be contacted via email on or about 1 business day of Winner Selection and will be asked to provide evidence of identity and eligibility, as well as their full name, address, including Zip and State, telephone number and email address.
• Winners may also be required to complete and return an Affidavit of Eligibility and Liability Release and; where legal, a Publicity Release. Completed documents must be returned within five (5) business days from prize notification date or the prize will be forfeited and awarded to an alternate potential Winner.
• Any false statement made by a potential Winner will result in automatic disqualification.
• Reasonable efforts will be made to contact the potential winner. Once eligibility has been confirmed, the winner will be confirmed as a winner. If the provisional winner does not respond to the initial contact within 2 days, we reserve the right to disqualify that entrant and award the Prize to an alternate selected at random, time permitting. An alternate winner may have less time to respond.
• The Sponsor is not responsible for any undelivered messages or emails, including without limitation, e-mails that are not received because of an entrant’s privacy or spam filter settings that may divert any winner notification or other Sweepstakes related email to a spam or junk folder.

Who Won:

To request the list of Winners, send an e-mail with subject line “Won and Done Sweepstakes [x] Period Winners” specifying the specific Quarterly or Major Prize Winner Entry Period to Won-and-donesweeps@promowinners.com. Requests must be received no later than October 30, 2024.

The list will be sent when the drawing(s) has been conducted and the Winners verified for the Entry Period you have requested.  Each Quarterly and the Major Prize drawing winners list request must be sent separately. 

For purposes of clarity, if you are requesting the winner list for Quarterly Entry Period 2, address your request to Won and Done Quarterly Entry Period 2 Winners.

Additional Terms and Conditions:

Moderation: The Sponsor reserves the right to reject entries which, in the reasonable opinion of the Sponsor:

• are in breach of the Official Rules;
• contain any content that is offensive, harmful, objectionable or which is otherwise unsuitable for publication including with respect to race, religion, origin or gender, or which could reflect negatively upon the name, reputation or goodwill of the Sponsor or any brand partner;
• contains or refers to any unauthorised third-party brand or reference any third-party names, logos and/or trademarks;
• promotes any political agenda.

Tax Obligations (if applicable for winners of prizes over $600): For the winner, the fair market value of the prize amount will be reported on the IRS form 1099-misc and issued to the recipient. Tax identity information will be collected by completing the IRS form W-9 for the winner. 

Failure of the Sponsor to enforce any term of these Rules shall not constitute a waiver of that provision and such provision shall remain in full force and effect. In the event of any conflict with any Sweepstakes details contained in these Rules and the Sweepstakes details contained in any Sweepstakes materials (including, but not limited to, point of sale, television and print advertising, or any other Sweepstakes media), the details of the Sweepstakes as set forth in these Rules shall prevail. The Sponsor reserves the right to modify any aspect of the Sweepstakes, including these Rules, at their sole discretion.

LIMITATION OF LIABILITY: By participating in this Sweepstakes, entrants and winners agree that the Sponsor and each of their respective affiliates, subsidiaries, representatives, consultants, contractors, legal counsel, advertising, public relations, fulfilment and marketing agencies, website providers and each their respective officers, directors, stockholders, employees, representatives, designees and agents (the “Released Parties”) are, to the extent permitted by law, not responsible for:

• Lost, late, incomplete, stolen, misdirected, undeliverable email notifications, or postal mail;
• any computer, satellite, cable, network, electronic or Internet hardware or software malfunctions, failures, connections, or availability;
• garbled, corrupt or jumbled transmissions, service provider/Internet/website/UseNet accessibility, availability or traffic congestion;
• any technical, mechanical, printing or typographical or other error;
• the incorrect or inaccurate capture of registration information or the failure to capture, or loss of, any such information;
• any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, technical error, theft or destruction or unauthorized access to the Sweepstakes;
• any property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in the Sweepstakes, or possession, acceptance and/or use or misuse of prize or participation in any sweepstakes-related activity and for any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property-related cause of action;
• any and all federal, state and local taxes;
• entries that are late, forged, lost, misplaced, misdirected, tampered with, incomplete, deleted, damaged, or otherwise not in compliance with the Rules; and
• for any loss (including, without limitation, indirect, special or consequential loss, punitive or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Sweepstakes or accepting or using a prize, except for any liability which cannot be excluded by law.

THIS SWEEPSTAKES AND ALL PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.

Participation in this Sweepstakes and acceptance of the prize constitutes each winner’s permission for Sponsor to use his/her name, address (city and state), likeness, photograph, picture, portrait, voice, biographical information, and/or any statements made by each winner regarding the Sweepstakes or Sponsor for advertising and promotional purposes without notice or additional compensation, except where prohibited by law for one year from the end of the Promotion Period. 

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

The Sponsor seeks to run a fair and secure promotion and prevent abuse and cheating. If you enter in a way that is not consistent with these Rules, your entries (and any of your associated aliases) will be disqualified. Any Prize awarded may be void and recoverable, and the Sponsor reserves the right to bar you from entering future promotions for a period of at least six months. For this reason, the Sponsor reserves the right at any point to:

• Verify the eligibility of entrants and/or provisional winners by requesting such information it considers reasonably necessary for this purpose. Entry or a Prize may be withheld until verification is completed.
• Disqualify entries that are not made directly by the individual entering the Promotion.
• Disqualify entries made using anonymous email services such as, but not limited to, GuerillaMail, Dispostable or Mailinator.
• Disqualify bulk entries from individuals, trade, consumer groups or third parties, incomplete entries and entries submitted by macros or other automated means.
• Disqualify entries beyond the maximum allowed, or those using techniques such as ‘script’, ‘brute force’, multiple SIM cards for text entries, masking identity by manipulating IP addresses, using aliases or identities other than their own or any other means.
• Disqualify entrants who tamper with the entry process.
• Disqualify entries which, in some other way, do not meet the requirements of these Official Rules.
• Cancel, modify or suspend the Promotion should it not be capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, dishonesty, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion.

No responsibility can be taken for entries which are lost, delayed, corrupted, damaged, postage due, misdirected or incomplete or which cannot be delivered for any technical, delivery or other reason. Proof of sending will not be accepted as proof of receipt.

By entering the Sweepstakes, each entrant agrees: (I) to be bound by these Rules, (ii) to waive any rights to claim ambiguity with respect to these Rules;(iii) to the extent permitted by law, to waive all of their rights to bring any claim, action or proceeding against any of the Released Parties in connection with the Sweepstakes; and (iv) to the extent permitted by law, to forever and irrevocably agree to release and hold harmless each of the Released Parties from any and all claims, lawsuits, judgments, causes of action, proceedings, demands, fines, penalties, liability, costs and expenses (including, without limitation, reasonable attorneys’ fees) that may arise in connection with: (a) the Sweepstakes, including, but not limited to, any Contest-related activity or element thereof, participation or inability to participate in the Sweepstakes;(b) the violation of any third-party privacy, personal, publicity or proprietary rights; (c) acceptance, attendance at, receipt, travel related to, participation in, delivery of, possession, defects in, use, non-use, misuse, inability to use, loss, damage, destruction, negligence or willful misconduct in connection with the use of a prize (or any component thereof); (d) any change in the Sweepstakes or prizing (or any components thereof); (e) human error; (f) any wrongful, negligent, or unauthorized act or omission on the part of any of the Released Parties; (g) lost, late, stolen, misdirected, damaged or destroyed prizing (or any element thereof); or (h) the negligence or willful misconduct by entrant.

If, for any reason, the Sweepstakes is not capable of running as planned, or the integrity and or feasibility of the Sweepstakes is severely undermined by any event beyond the control of the Sponsor, the Sponsor will not be liable for any failure to comply with their obligations or any delay in performing their obligations within these Rules if an act, omission, event or circumstance occurs caused by (but not limited to) global or regional health crises, weather conditions, fire, flood, strike, hurricane, earthquake, explosion, industrial dispute, war, terrorist activity, any federal, state, provincial or local government law, order, or regulation, order of any court or jurisdiction, hostilities, political unrest, riots, civil commotion, epidemic, pandemic, famine, plague or other natural calamities and acts of God or any other circumstances beyond the reasonable control of the Sponsor (each a “Force Majeure” event or occurrence).

If any part/s of these Official Rules are legally ruled to be invalid, illegal or unenforceable, the remainder will not be affected and will continue in full force and effect.

By entering, you will be deemed to have agreed to be bound by these Official Rules.

If there is a discrepancy between these Official Rules and those in any promotional material, these Official Rules will prevail.

Disputes; Governing Law:  The parties waive all rights to trial in any action or proceeding instituted in connection with these Official Rules, including, without limitation, the Sweepstakes. Any controversy or claim arising out of or relating to these Official Rules and/or the Sweepstakes shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party.  The arbitration shall be conducted in the state of Georgia.

THESE OFFICIAL RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF GEORGIA WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES. For any matters which are not subject to arbitration as set forth in these Official Rules and/or in connection with the entering of any judgement on an arbitration award in connection with these Official Rules and/or the Sweepstakes, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of the state and federal courts located in in the State of Geogia. The parties agree not to raise the defense of forum non conveniens.

BarkBox™ and meowbox® are not participants in or Sponsor of this Sweepstakes nor do they endorse or support this Sweepstakes in any way, and their names and logos are a registered trademark of each.  You understand that you are providing your information to the Sponsor, and not BarkBox™ or meowbox®. The information you provide will only be used for verification of your eligibility to participate in the Sweepstakes. Any questions, comments or complaints regarding the Sweepstakes are to be directed to the Sponsor, at the address above, not to BarkBox™ or meowbox®.
